Partner Action: Protest the Unlawful Detainment of Venezuelan Immigrants
As part of a crackdown on immigration, Trump invoked the Alien Enemies Act of 1798 (AEA) to expedite the removal of Venezuelan noncitizens linked to Tren de Aragua (TdA), a criminal organization he claimed was invading the U.S.
The AEA, an obscure law allowing deportation during wartime, can only be invoked after Congress declares war and has been used only three times in U.S. history. A federal judge quickly blocked Trump’s proclamation, ordering that flights carrying Venezuelan detainees be turned around.
However, Trump administration officials defied this ruling, transferring these immigrants to El Salvador’s CECOT prison, known for its brutal conditions. Judge Boasberg raised concerns about the legality of using the AEA in a non-wartime context and the due process rights of those detained. Many deported Venezuelans have no criminal records and were targeted based on tattoos. This misuse of the AEA raises serious constitutional issues and threatens the rights of innocent individuals.
